Terms of Service

1. Agreement to Terms

By accessing or using the Lawnzie mobile application or website (“Platform”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the Platform.

You must be at least 18 years old and a legal resident of the United States to use the Platform.

2. Platform Description

Lawnzie operates an online marketplace that connects homeowners seeking lawn care and landscaping services (“Homeowners”) with independent contractors who provide such services (“Contractors”). Lawnzie is a technology platform and marketplace only. Lawnzie does not provide lawn care, landscaping, or any other services directly.

3. Independent Contractor Relationship

Contractors are independent contractors, not employees, agents, or representatives of Lawnzie. Lawnzie does not control the manner, method, or means by which Contractors perform Services. Contractors set their own schedules, determine which jobs to bid on, set their own pricing, provide their own equipment, and are responsible for the quality of their work.

Contractors are solely responsible for all tax obligations, including self-employment taxes. Lawnzie will issue IRS Form 1099-NEC or 1099-K as required by law.

Contractors are solely responsible for obtaining and maintaining any licenses, permits, and insurance required by applicable law.

4. How the Platform Works

Homeowners post jobs describing the services they need. Contractors submit quotes with itemized pricing. When a Homeowner accepts a quote, a binding agreement is formed directly between the Homeowner and the Contractor. Lawnzie is not a party to this agreement.

5. Payments and Fees

Lawnzie charges a service fee on completed transactions, disclosed before finalization. Payments are processed through Stripe, Inc. By using the payment features, you agree to the Stripe Connected Account Agreement.

Lawnzie acts as a limited payment collection agent on behalf of Contractors. Contractor earnings, less applicable fees, are transferred to linked bank accounts within approximately 2 business days.

6. Background Checks

Lawnzie may offer background checks through a third-party consumer reporting agency. Background check disclosures and authorizations are provided in a separate document as required by the FCRA. Consent to a background check is not granted by agreeing to these Terms.

Background checks and verification badges do not constitute a guarantee of any Contractor's qualifications, character, or fitness.

7. User Conduct

All Users agree to provide accurate information, treat others with respect, comply with applicable laws, and not discriminate on the basis of any protected class. Users shall not misrepresent themselves, engage in fraud, circumvent the Platform to avoid fees, or harass other Users.

8. Content and Intellectual Property

The Platform is the exclusive property of Lawnzie. By submitting Content (photos, reviews, messages), you grant Lawnzie a non-exclusive, worldwide, royalty-free, perpetual license to use such Content in connection with the Platform.

9. Disclaimers

THE PLATFORM IS PROVIDED “AS IS” WITHOUT WARRANTIES OF ANY KIND. LAWNZIE DOES NOT ENDORSE OR GUARANTEE THE QUALITY, SAFETY, OR LEGALITY OF SERVICES PROVIDED BY CONTRACTORS.

10. Limitation of Liability

LAWNZIE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. LAWNZIE'S TOTAL LIABILITY SHALL NOT EXCEED THE FEES PAID BY YOU IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.

11. Dispute Resolution

Before initiating formal proceedings, you agree to attempt informal resolution for at least thirty (30) days. Unresolved disputes shall be resolved through binding individual arbitration administered by the AAA.

CLASS ACTION WAIVER: You agree to bring claims only in your individual capacity, not as part of any class, consolidated, or representative proceeding.

You may opt out of arbitration by sending written notice to legal@lawnzie.com within thirty (30) days of accepting these Terms.

12. Termination

You may terminate your account at any time. Lawnzie may suspend or terminate accounts at its discretion. Upon termination, earned but unpaid Contractor funds will be disbursed per the normal payout schedule.

13. General Provisions

These Terms are governed by the laws of the State of North Carolina. Lawnzie may modify these Terms with 30 days' notice. If any provision is unenforceable, the remaining provisions remain in effect.

14. Contact

By using the Lawnzie Platform, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
